Andreas Flach

As a service provider, we are responsible for our own content on these pages under the general laws (§ 7(1) DDG). Under §§ 8–10 DDG, however, we are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity.

Liability for external links

Our pages occasionally link to third-party offerings. We have no influence on the content of those external sites and accept no liability for them; responsibility lies with the respective providers. 2. Hosting & Content Delivery Networks (CDN)

Hosting at Hetzner Online GmbH

This website is hosted on our behalf by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (“Hetzner”). When you access the website, Hetzner processes technically required access data, in particular IP address, date and time of the request, requested URL, referrer URL, browser type and operating system. The use of Hetzner as a hosting provider is in the interest of a secure, fast and efficient provision of our online offer by a professional provider. Legal basis is Art. 6(1)(f) GDPR; our legitimate interest is the reliable provision of the website.

Hetzner processes personal data only to the extent necessary to provide the hosting service and according to our instructions. Further information on data processing at Hetzner: https://www.hetzner.com/de/rechtliches/datenschutz/.

3. General notes & mandatory information

Data protection

We handle your personal data confidentially and in accordance with applicable data protection law, in particular the GDPR and the German Federal Data Protection Act (BDSG).

This privacy declaration explains what data is collected when you visit this website, what we use it for, to whom it may be passed on, and what rights you have.

Note: data transmission over the internet (for example by email) can in principle exhibit security gaps. Complete protection against unauthorised third-party access cannot be guaranteed outside our sphere of control.

Note on the responsible party

Responsible for data processing on this website within the meaning of the GDPR is:

ND-DESIGN.WORKS GmbH
ANDREAS FLACH
HEAD OF DESIGN

Rhein-Wied-Str. 5
56587 Oberhonnefeld-Gierend
Germany

Phone number: +49 151 2021 1978
E-Mail: nd@nd-design.works
Website: ND-DESIGN.WORKS

The controller within the meaning of the GDPR is the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data.

Withdrawal of consent

Where processing is based on your consent, you may withdraw it at any time with effect for the future. An informal email is sufficient. The lawfulness of processing carried out before the withdrawal remains unaffected.

Right to object (Art. 21 GDPR)

IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 ABS. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS FOR THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION UNDER ARTICLE 21(1) DSGVO).

Where processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object, on grounds relating to your particular situation, at any time. Where data is processed for direct marketing purposes, you may object at any time without giving reasons — however, we do not engage in direct marketing.

Right to lodge a complaint

You have the right at any time to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). For our registered office, the competent authority is the Landesbeauftragter für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz (lfd.rlp.de).

Data portability (Art. 20 GDPR)

Where we process data automatically on the basis of your consent or in the performance of a contract, you have the right to receive that data, or have it transferred to a third party, in a structured, commonly used, machine-readable format.

SSL/TLS encryption

This website is delivered exclusively over HTTPS. Transmission between your browser and our server is SSL/TLS-encrypted. You can recognise this by the lock symbol in your browser and the https:// prefix in the address bar.

When encryption is active, third parties cannot read the contents of your requests.

Information, correction, deletion

You have the right at any time, free of charge, to information about your personal data stored by us, its origin, recipients and the purpose of processing (Art. 15 GDPR), as well as to correction (Art. 16) and deletion (Art. 17). Please contact us informally by email or post.

Restriction of processing (Art. 18 GDPR)

You have the right to request that we restrict processing of your personal data. This applies in particular in the following cases:

  • If you dispute the accuracy of the personal data we hold, processing can be restricted for the duration of the verification.
  • If processing has taken place or is taking place unlawfully, you can request restriction instead of erasure.
  • If we no longer need the data but you need it for the establishment, exercise or defence of legal claims, you may request restriction instead of erasure.
  • If you have objected under Art. 21(1) GDPR, processing is restricted until it is determined whose interests prevail.

Where processing is restricted, the data — apart from its storage — may only be processed with your consent, for the establishment, exercise or defence of legal claims, for the protection of others, or for reasons of important public interest of the EU or a Member State.

4. Data collection on this website

Cookies

This website does not use any tracking, analytics or marketing cookies and does not integrate any external tracking services. We only use technically necessary or user-triggered local browser storage (Local Storage).

Specifically, the following local entries are stored in your browser as soon as you trigger the respective function: nd-theme (theme preference), nd-cookie-info-dismissed-v2 (acknowledgement of the cookie notice), preferredLocale (language preference). The website runtime may additionally read existing browser cookies but does not set any in the production build.

These values are stored locally on your device. They are not transferred to third parties. You can delete these entries at any time via your browser settings or by clearing the local website storage for this domain.

This website does not use cookies or comparable technologies for advertising, tracking or analytics purposes. Beyond the local browser entries described in section 4, no information is stored on your device.

The legal basis for storing and accessing this information is Section 25(2) No. 2 TDDDG, as the storage is necessary to provide the website functions requested by you.

Where personal data is processed, the legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is the user-friendly, stable and data-minimising provision of the website.

Data minimisation

We deliberately do not use cookie consent managers, tracking frameworks or third-party scripts. Because no consent-requiring technologies are in use, no consent management is needed.

Apart from the technically required processing by our hosting provider (see section 2), no personal data is transferred to third parties.

If you have dismissed our cookie notice banner, your dismissal is stored as a local entry in your browser (Local Storage, key nd-cookie-info-dismissed-v2). You can delete this entry at any time via your browser settings.

Server log files

Each time a page is requested, our hosting provider Hetzner Online GmbH stores technically required access data in so-called server log files, which your browser transmits automatically. The following information is recorded in particular:

  • Browser type and browser version

  • Operating system used

  • Referrer URL

  • Host name of the accessing computer

  • Time of the server request

  • IP address

This data is not merged with other data sources.

Processing is based on Art. 6(1)(f) GDPR. Our legitimate interest is the secure, stable and technically correct provision of the website.

Contact form

Note: This website does not contain a contact form. Please contact us by email or phone (see imprint).

The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested.

These data remain with us until you ask us to delete them or until the purpose for storage ceases and no statutory retention or evidence obligations conflict.

Inquiry by e-mail, telephone or fax

If you contact us by email or phone, we process the information you provide (name, contact details and content of your enquiry) solely to handle your request. We do not pass these data on to third parties without your explicit consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests sent to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested.

The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular legal retention periods - remain unaffected.

Functions we deliberately do not offer

This website deliberately does without contact forms, comment functions, login areas, newsletter sign-ups and social media embeds. No comments, IP addresses or profile pictures of visitors are processed, and no newsletter is sent.

Storage of the IP address
Our comment function stores the IP addresses of users who post comments. Since we do not check comments on this website before they are activated, we need this data to be able to take action against the author in the event of legal violations such as insults or propaganda.

Storage period of comments
The comments and the associated data (e.g. IP address) are stored and remain on this website until the commented content has been completely deleted or the comments have to be deleted for legal reasons (e.g. insulting comments).

Legal basis
The storage of the comments is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke any consent you have given at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing operations already carried out remains unaffected by the revocation.

5. Fonts

Locally hosted fonts

We use the typefaces Inter and DM Sans. Both are delivered exclusively from our own hosting. No connection to Google Fonts or any other external font provider is established when you access the website; in particular, your IP address is not transmitted to third parties.

If your browser does not support one of these font packages, it will fall back to a system-default font.
